O alojamento do recluso no estabelecimento prisional deve respeitar a sua dignidade. Os dados oficiais, até dezembro de 2020, revelam sobrelotação em algumas prisões. Analisamos a problemática no foro constitucional, dos direitos de personalidade e do direito penitenciário, recorrendo a fontes legais e doutrinárias. Concluímos que a sobrelotação configura um problema que tem de ser ultrapassado e que existe um claro desfasamento entre a law in the books e a law in action.

Neste texto analisamos blogs da Internet como espaços educativos nos quais se produzem/constroem as identidades juvenis de indivíduos que buscam se inserir no grupo cultural conhecido como nerd/geek. Inseridos nos Estudos Culturais, na sua vertente pós-moderna e pós-estruturalista, valemo-nos da noção de Representação Cultural para analisar como as identidades são constituídas com a escrita/leitura de blogs disponibilizados na web. Destacamos que a forma como se dá o agrupamento dos jovens que escrevem/leem os blogs é efêmera e espontânea, baseada no prazer (...) de estar junto, no consumo de alguns itens e no estabelecimento de alguns laços afetivos momentâneos. Tal compartilhamento tem semelhança com outras “tribos” urbanas deste início de século XXI. Destacamos, também, que não estamos associando a juventude a uma faixa etária particular, mas, isto sim, a um estilo de vida fortemente ligado ao lazer e ao consumo. Os blogs analisados, ao colocarem em circulação representações de identidades nerd/geek, contribuem para a produção discursiva dessas mesmas identidades em função dos modos como os/as integrantes desse grupo partilham formas de apropriar-se de saberes diversos, de utilizar equipamentos tecnológicos, de consumir produtos comerciais e textos midiáticos. ResumoEste artigo analisa o reendereçamento da obra Fita verde no cabelo: nova velha estória ao público infantojuvenil. Em 1992, o conto de Guimarães Rosa foi reeditado pela Nova Fronteira, contando com novo projeto gráfico e com as ilustrações de Roger Mello, em edição dedicada ao público jovem. Além de observar o modo como a obra busca o diálogo com esse público em níveis textuais e imagéticos, o estudo concentra-se na análise das ilustrações. Verifica-se a hipótese de que as imagens, (...) em vez de apenas facilitarem a leitura para um público específico, expandem o sentido da obra original contemplando todos os públicos. Como resultado, demonstra-se a potência das imagens e sua capacidade de enriquecer a experiência de leitura do conto de Rosa.Palavras-chave: João Guimarães Rosa. Reendereçamento. Ilustração. This study focuses not only on how the story is looking for dialogue with the young audience in written-text and visual-image levels, but also in the analysis of illustrations. We verify the hypothesis that the images do not facilitate the reading process for a specific audience, for they are in turn ways to expand the meanings of the original work. In this article, the author describes sweeping changes in the gender system and offers explanations for why change has been uneven. Because the devaluation of activities done by women has changed little, women have had strong incentive to enter male jobs, but men have had little incentive to take on female activities or jobs. The gender egalitarianism that gained traction was the notion that women should have access to upward mobility and to all areas of schooling and jobs. But persistent (...) gender essentialism means that most people follow gender-typical paths except when upward mobility is impossible otherwise. Middle-class women entered managerial and professional jobs more than working-class women integrated blue-collar jobs because the latter were able to move up while choosing a “female” occupation; many mothers of middle-class women were already in the highest-status female occupations. The author also notes a number of gender-egalitarian trends that have stalled. (shrink)

Despite the widely known Latin proverb, according to which about tastes it should not be discussed, concerning judgments of taste, we do dispute. However, based on what? If someone disagrees with our judgment, judging differently than us, we seek arguments to try to convince them otherwise. But by which arguments? The paper dwells on the issues about what underlies the arguments we use to justify our judgments of taste and how reliable these arguments are. From eighteenth-century philosophy to contemporary philosophy (...) of consciousness and mind, the aim here is to show that judgments of taste involve self-knowledge and that the question “how does it feel?”, at first glance simple, does not seem to be so easy to answer. Returning to the famous prologue to the book Difference and Repetition, in which Gilles Deleuze points out that the time is approaching when it would not be possible to write a philosophy book as before, we will try to think about the deleuzian evocation of the need to adopt a new tone and new rules for the exercise philosophical. We believe that resuming this philosopher's appeal would launch us into the heart of deleuzian and deleuze-guattarian conception of philosophy as experimentation. (...) The author suggesting that a philosophical treatise should sound as much like a kind of detective novel as it does like science fiction. This excursion, we argue, would not only help us in the deleuzian and deleuzo-guattarian understanding of philosophy as experimentation, but would also make it possible to outline some clues about the role of the history of philosophy at the heart of this conception. A major obstacle for materialist theories of the mind is the problem of sensory consciousness. How could a physical brain produce conscious sensory states that exhibit the rich and luxurious qualities of red velvet, a Mozart concerto or fresh-brewed coffee? Caging the Beast: A Theory of Sensory Consciousness offers to explain what these conscious sensory states have in common, by virtue of being conscious as opposed to unconscious states. After arguing against accounts of consciousness in terms of higher-order representation of (...) mental states, the theory claims that sensory consciousness is a special way we have of representing the world. The book also introduces a way of thinking about subjectivity as separate and more fundamental than consciousness, and considers how this foundational notion can be developed into more elaborate varieties. An appendix reviews the connection between consciousness and attention with an eye toward providing a neuropsychological instantiation of the proposed theory. (shrink)

Language is a cognitively demanding human trait, but it is also a fundamentally cooperative enterprise that rests on the motivation to share information. Great apes possess many of the cognitive prerequisites for language, but largely lack the motivation to share information. Callitrichids (including marmosets and tamarins) are highly vocal monkeys that are more distantly related to humans than great apes are, but like humans, they are cooperative breeders and all group members help raising offspring. Among primates, this rearing system is (...) correlated with proactive prosociality, which can be expressed as motivation to share information. We therefore propose that the unique coincidence of these two components in humans set the stage for language evolution: The cognitive component inherited from our great ape-like ancestors, and the motivational one added convergently as a result of cooperative breeding. We evaluate this scenario based on a review of callitrichd vocal communication and show that furthermore, they possess many of the mechanistic elements emphasized by the mirror system hypothesis of language evolution. We end by highlighting how more systematic phylogenetic comparisons will enable us to further promote our understanding of the role of cooperative breeding during language evolution. (shrink)

Cause-related marketing has risen to become a popular strategy to increase business value through profit-motivated giving. Despite the growing number of articles published in the last decade, no comprehensive analysis of the most discussed constructs of cause-related marketing is available. This paper uses an advanced Text Mining methodology to conduct a comprehensive analysis of 246 articles published in 40 different journals between 1988 and 2013 on the subject of cause-related marketing. Text Mining also allows quantitative analyses to be performed on (...) the literature. For instance, it is shown that the most prominent long-term topics discussed since 1988 on the subject are “brand-cause fit”, “law and Ethics”, and “corporate and social identification”, while the most actively discussed topic presently is “sectors raising social taboos and moral debates”. The paper has two goals: first, it introduces the technique of CTM to the Marketing area, illustrating how Text Mining may guide, simplify, and enhance review processes while providing objective building blocks to be used in a review; second, it applies CTM to the C-RM field, uncovering and summarizing the most discussed topics. Mining text, however, is not aimed at replacing all subjective decisions that must be taken as part of literature review methodologies. (shrink)

We propose a liminality-based analysis of the process of ethical leadership/followership in organizations. A liminal view presents ethical leadership as a process taking place in organizational contexts that are often characterized by high levels of ambiguity, which render the usual rules and preferences dubious or inadequate. In these relational spaces, involving leaders, followers, and their context, old frames may be questioned and new ones introduced in an emergent way, through subtle processes whose evolution and implications may not be easy to (...) grasp even by those participating in them. There is growing evidence to support the claim that we react differently to robots than we do to other objects. In particular, we react differently to robots with which we have some form of social interaction. In this paper I critically assess the claim that, due to our tendency to become emotionally attached to social robots, permitting their harm may be damaging for society and as such we should consider introducing legislation to grant social robots rights and protect them from (...) harm. I conclude that there is little evidence to support this claim and that legislation in this area would restrict progress in areas of social care where social robots are a potentially valuable resource. Stigma taints individuals with a spoiled identity and loss of status or discrimination. This article is the first to examine the stigma attached to abortion and surrogacy and consider how law may stigmatize women for failing to conform to social expectations about maternal roles. Courts should consider evidence of stigma when evaluating laws regulating abortion or surrogacy to determine whether these laws are based on impermissible gender stereotyping.

Forgiveness as a positive response to wrongdoing is a widespread phenomenon that plays a role in the moral lives of most persons. Surprisingly, Kant has very little to say on the matter. Although Kant dedicates considerable space to discussing punishment, wrongdoing and grace, he addresses the issues of human forgiveness directly only in some short passages in the Lectures on Ethics and in one passage of the Metaphysics of Morals. As noted by Sussman, the TL passage, however, betrays some ambivalence. (...) Kant establishes a duty of virtue to be forgiving (TL, 6:460), yet he immediately warns against its excess: meek toleration of recurrent wrongs could manifest a lack of self-respect and a violation of a duty to oneself (TL, 6:461). Sussman claims that this ambivalence ultimately arises from the fact that forgiveness sits uncomfortably in Kant’s moral thought. First, forgiveness has an ‘ineluctably elective aspect’ that makes it, to a certain extent, arbitrary and dependent on particular features of the forgiver’s psychology and, as such, in tension with Kant’s central claims that human beings are autonomous agents capable of determining their own moral status. Second, according to Sussman, Kant’s moral retributivism, i.e. ‘the particular moral position that every moral wrong against another deserves punishment of the wrongdoer’ seems to be in tension with the possibility of a ‘truly redemptive forgiveness’. Moreover, forgiveness also seems to be in tension with a passage of the Religion in which Kant argues that the moral guilt from our original evil disposition cannot be understood as a debt or liability that can be compensated, erased, transferred or otherwise wiped out by others (Rel, 6:72). Thus, to the extent that forgiveness might be thought to involve the forgoing of moral guilt, it seems incompatible with Kant’s views on culpability and punishment. This chapter seeks to clarify Kant’s views on forgiveness in order to show that, although not often appreciated, personal forgiveness plays an important role in the lives of ordinary human agents as understood by Kant. In particular, I aim to show there is a conception of forgiveness available to Kant that is not incompatible with Kant’s views of punishment and culpability. In Section 1, I argue that, for Kant, far from being merely ‘elective,’ forgiveness is, under certain conditions, morally required. I provide a brief summary of an interpretation of Kant’s theory of forgiveness that I have defended in recently published work , in order to argue that Kant’s duty to be forgiving should be understood as an imperfect duty of virtue which is conditional on repentance. Kant is not ambivalent about this duty because he maintains that when the relevant conditions are not met, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. The TL passage thus identifies two different duties. In Section 2, I show that forgiveness, as conceptualised by Kant, does not require the forgoing of punishment or the overcoming of moral guilt and that this could, in fact, be seen as an attractive feature of Kant’s position. In this article I argue against the arbitrariness of the concept of music and for an essentialist and naturalist framework, according to which music is a cross-cultural human phenomenon, defined by relational properties held together by uniform features of human nature. Building on Dickie’s classification of theories of art in natural kind theories and cultural-kind theories, I argue for an enhanced natural-kind theory (which explains the institutional element), and use some developments in social ontology to show the inadequacy of an (...) institutionalist approach to art and music. Testimony is a source of knowledge. A speaker asserts what a hearer may therefore come to know. Assertion has widely been treated as the exclusive or at least the paradigmatic vehicle for testimony. I argue that we testify not only by asserting something, but also by taking something for granted within some other utterance. In philosophy of language, this is called semantic presupposition. Images abound of women throughout the ages engaging in various activities. But why are there so few representations of childbirth in visual art? Feminist artist Judy Chicago once suggested that depictions of women giving birth do not commonly occur in Western culture but can be found in other contexts such as pre-Columbian art or societies previously considered "primitive." Chicago's own exploration of the theme resulted in the creation of The Birth Project (1980-85): an unprecedented series of eighty handcrafted works of (...) art created in a variety of needlework techniques by more than 130 artisans that celebrate the experience of birth and a woman's transformation into motherhood. But why is The Birth Project an aberration from today's norm? What are the reasons that childbirth remains a taboo subject in our visual culture? Why is the birthing experience--so pervasive for women--so infrequently celebrated, even by female artists? (shrink)

This paper adds to what is already known on this topic, as there is not an explicit contribution to the literature of this specific Manifesto , its significance, and utility for the discipline. While each of us have written on emancipatory knowing and social justice in a variety of works, it is in this article that we identify, as a unit of knowledge production and as a direction towards praxis, a set of critical values that arose from the emancipatory conscience-ness and intention seen in the framework of the Nursing Manifesto. In this essay, Paula McAvoy critiques a commonly held view that teaching young people to be good choice makers should be a central aim of sex education. Specifically, she argues against David Archard's recommendation that sex educators ought to focus on the development of autonomy and teaching young people that “choice should be accorded the central role in the legitimation of sexual conduct.” Instead, McAvoy argues that under conditions of gender inequality this view advantages boys and disadvantages girls. Juxtaposing (...) a case of a culturally arranged marriage with a spring break scene from Ariel Levy's Female Chauvinist Pigs: Women and the Rise of Raunch Culture, McAvoy shows that focusing on sexual choice making obscures and reifies the unequal social conditions that young people navigate. She concludes by suggesting an alternative that is in line with Sharon Lamb's argument in “Just the Facts? The Separation of Sex Education from Moral Education” that intimate encounters are better governed by attending to our ethical obligations to others. (shrink)

Os anos que passamos na graduação geralmente costumam ser marcante em nossas vidas, afinal de contas, esses momentos formativos que compartilhamos com os colegas de curso e com os professores/as, ao longo de quatro anos, são fundamentais para nos tornarmos os profissionais que somos hoje. A leitura dos textos, as discussões em sala, as relações de afeto que construímos nesse período, o papo com os professores, a preparação e apresentação dos seminários, as madrugadas em claro fazendo os trabalhos das disciplinas, (...) as reflexões que guardamos na consciência após uma reunião dos grupos de estudo, as confraternizações que costumamos realizar no termino das disciplinas, isto é, todos essas vivências que um estudante universitário costuma ter marca de maneira definitiva a nossa história. E arrisco a dizer, sem receio de ser injusto, que essas experiências passam a ter um significado ainda maior quando nos tornamos efetivamente professores/as. (shrink)

Que sabe contar com riqueza de detalhes as mudanças arquitetônicas que o prédio sofreu, como se deu o início do curso, quem eram os professores/as, qual era o nome das disciplinas do antigo currículo, bem como das transformações pedagógicas e curriculares realizadas ao longo da história para que ele se tornasse aquilo que ele é hoje. Não é (...) fácil encontrarmos alguém no presente que continua a manter viva a memória cristalina de um passado pouco documentado. Sem nenhuma dúvida, existem poucos professores e professoras na Universidade Federal do Piauí que possuem o privilégio de serem esse “contador de histórias” do curso que trabalham, que possuem uma vivência longa com a instituição. No caso do curso de Filosofia da UFPI, este docente possui nome e sobrenome: Gerson Albuquerque de Araújo Neto. (shrink)

GESTÃO DE RESÍDUOS SÓLIDOS EM MEGAVENTOS: ASPECTOS CONCEITUAIS.

In this article we consider Putnam’s project of an “ethics without ontology,” focusing on some of its crucial aspects, namely, the entanglement of fact and value and the idea of forming and “imaginatively identifying” with a “particular evaluative outlook.” We use that approach to shed light on the issue of value objectivity. Putnam’s “pragmatist enlightenment” suggests a way of abandoning the traditional project of grounding ethics and aesthetics on metaphysics, preserving the idea of realism and objectivity about values. Ethical and (...) aesthetic discriminations may be contextually specific and depend on the responses and the socially embedded experience of observers, but they are brought about by certain features of reality, far more complex than a domain of “objects” that would “correspond” to values. With our eyes set on these aspects, we draw important lessons for the project of a joint approach to aesthetic and ethical value, taking seriously the pervading entanglement of both, as suggested by the way we are able to apply the so-called thick concepts. This provides us with the outline of a contextualist approach to aesthetics that draws on Putnam’s project for ethics. We conclude by suggesting that a fruitful way of pursuing this connection could be found in co-opting resources from virtue ethics. (shrink)

In her last novella, The Hour of the Star, Lispector makes plain that the brilliance of life – any life whatever – lies in its capacity to endlessly contemplate itself and that as such it is inseparable from its mode of contemplation. As we will suggest in this article, Lispector’s view of life as living contemplation resonates with Giorgio Agamben’s conception of being as potentiality. In the last installment of his Homo Sacer series, The Use of Bodies, Agamben tries to (...) offer an alternative paradigm of life to that of Western biopolitics, whose power operates on its separation of bare life from forms of life. Central to this new ontology is Agamben’s notion of a life as inseparable from its mode or form, as he highlights using a hyphen: form-of-life. By form-of-life, Agamben means that one’s living is never reducible to the biological or economic facts of existence because it essentially concerns itself with its potentialities, its singular modes of being. Life that contemplates itself is a life which simply is without being reducible to its function. In The Hour of the Star, Lispector’s heroine, Macabéa is not simply a figure of bare life as some critics have suggested by reducing her life to her factual circumstances. She is rather a figure whose life is affected by its own sensation of existing – its unborn possibilities. (shrink)

While Aristotle's account of the happy life continues to receive attention, many of his claims about virtue of character seem so puzzling that modern philosophers have often discarded them, or have reworked them to fit more familiar theories that do not make virtue of character central. In this book, Paula Gottlieb takes a fresh look at Aristotle's claims, particularly the much-maligned doctrine of the mean. She shows how they form a thought-provoking ethic of virtue, one that deserves to be (...) developed and refined. The first part of the book addresses the nature of virtue and the virtues, illuminated by the doctrine of the mean. En el artículo realizaré un estudio de algunos pasajes de Troyanas de Eurípides, en busca de posibles sentidos de justicia en el texto. It is becoming clear that many of today’s management theories are inadequate theoretically and practically to move understanding, scholarship, and practice to where it needs to be for scholars, business leaders, and policy makers to cope with an increasing fraught world. This Special Issue’s focus is on sustainability. Sustainability challenges need to incorporate multidisciplinary interventions and the trans- and interdisciplinary nature of solutions. To actively seek transformation toward sustainability, fundamental and innovative short-term as well as long-term efforts are required in (...) society, economy, technology, and education, including our understanding of human behavior and attitudes toward the management of the environment. This introductory piece presents natural science theories as a promising approach for achieving progress toward transformation for sustainability. (shrink)

According to the authors of Populism and Civil Society, ‘populism is situated within the democratic imaginary’ but its logic is authoritarian. This article agrees with the first but challenges the second argument by focussing on the question of representation. In the case of ‘populism as government’ the tensions between bottom-up and top-down articulations seem to be more or less resolved by the repression of bottom-up organization, but in so doing, so the argument of this article, populism is mutating into something (...) else. Furthermore, ‘populist dictatorship’ seems to be closer to a dictatorship strategically using populist tools than to an intrinsic populist logic. While I agree with the authors on the authoritarian cases of populism in government, my argument diverges from the book when it comes to populism as government and introduces a discussion about the nature of populism. To this purpose, I first propose a complex definition of populism which understands populism not as the essence, but as one component of hybrid authoritarian formations, thus enabling the disentanglement of populism, authoritarianism, and totalitarianism. Second, I examine two components of populism that Arato and Cohen lay out in the book: the specific representation pars pro toto and embodiment. Building on Lefort, I argue that these components are not populist but totalitarian and that the empirical manifestations of populism are always hybrid, mixing populist and authoritarian or even totalitarian components.
